xx0r.info is, among other things, a web and shell host. I realize that people are fucking morons, and occasionally decide to break my TOU despite having checked the box when they created their account legally obligating them to follow it.

If you are a copyright holder and have fallen victim to said fucking morons, please e-mail dmca@xx0r.info with all the information you would usually put in a DMCA takedown request. This includes:

If you fail to include any one of the above, your request will be ignored.

If your takedown request runs counter to the law (i.e. you request to have content exempted under Fair Use removed), I will sue you. If the law permits it, I will also press criminal charges for perjury. Think carefully about whether you have the right to order a takedown.

Whether or not your request is deemed valid, I reserve the right to post a copy of your notice publicly.

When I get your e-mail...

I will contact the user responsible and give them 24 hours to delete it themselves. I will give them all the contact information you gave me.

I will make clear to the user that if they have a good faith belief that their actions are within the bounds of Fair Use, they have every right to file a counter-notice, and will assist them in writing it if necessary.

I will delete it myself if 48 hours pass and I don't get a response. I will perform my own investigation before deleting the content to see if I think it falls under Fair Use, and will send a counter-notification on behalf of my user if I believe it does.

I will not disclose the user's identity to you unless legally obligated to do so (i.e., subpoena). You have no reason to know my users' real life info if they complied with your request. In many cases, I don't actually know their real identity.

The bottom line: Everyone who gets an account here gets it for a reason, and a darned good one. I believe that none of my users are fucking morons, and I treat them with respect. Lawyers for Big Media are usually bigoted, enjoy jumping to conclusions, and typically work with the flawed goal of preserving outdated, consumer-unfriendly business models that will fail in the long run.
